Infringement on VPN?

My friend (seriously lol) got a few infringement notices for streaming movies on Kodi (he’s a very heavy user of Kodi since it’s his only source of content so he streams like all day every day). So he decided to get a VPN.

He’s been using the VPN for quite some time (think it’s vpn shark or something, but I could be wrong) if you need the exact one I can find out.

However, for the first time after many months he got hit with another for watching ‘the menu’ and it had his VPN IP listed in the letter. He has options checked that should kill the connection if it’s not going through the VPN and I believe everything setup right.

One thing is for this particular movie he was using Elementium or whatever is name is which uses torrents.

Since it’s using torrents in this scenario, I’m not as familiar with how it would be traced. So I guess my question would be…

  1. could it just be a dns leak still?
  2. vpn gave up the real user
  3. Internet provider somehow analyzed his traffic
  4. since its a torrent - from having to share the file while watching?
  5. other?
  6. Used VPN for long periods without reconnecting and getting new ip

He’s been doing it for so long it’s kinda weird this one came out of no where. Without the VPN he got multiple in a day and 26 low severity ones from May until June and they all stopped when he got the VPN until just now.

Anyway if anyone might have some suggestions it would be appreciated. I know it’s impossible to know for sure the way I’m explaining it, but it really isn’t my setup.

Thank you for your time.

Tell your friend to dump the VPN and get a Real Debrid subscription. No VPN required.

Probably using a shite vpn that hasn’t got any leak protection

Either he needs to get a better vpn that isn’t shit or a debrid account

it had his VPN IP listed in the letter

So his VPN provider gave out his address?

Why did they have it in the first place?

Is your friend in the UK. I’m in Ny and never had an issue in over 10 years

You have to disable IPv6 when using most VPNs as they’ll only shield your IPv4 address. I disabled IPv6 at the router to make sure that Windows didn’t reset my settings or that I didn’t forget while mucking around with Linux or something.

It would be a very surprising thing of the VPN forwarded his information unless the rightsholder got a court order (at which point the VPN would just be shit because that meant they logged everything).

Surfshark (I’m assuming that’s who he has based on you mentioning shark in the name) has always seemed like a decent provider. I would be surprised if they forwarded the info to the rightsholder but who knows?

Also, don’t listen to everyone who says that RD will protect him. RD’s own terms flat out say they’ll give up your information if they’re forced to.

We may be required to disclose Users personal data in order to protect our legal rights or where disclosure of Users personal data’s are required of us by the judicial authorities only when legal procedures are followed.

They also log everything.

Files links that Users download are stored in a database for legal concerns and our internal use. All saved links are erased within 1 month for security reasons and service needs. However all requests made on our site are stored for 1 year, the legal retention period.

While it seems unlikely at this point that there would suddenly be a bust of RD, they’re very accessible being in France, and the fact they are suddenly complying with DMCA takedowns tells me that the authorities are quite aware of what their services facilitate. The US and EU have been known to work together on things like this and the customer lists would no doubt be shared. Now whether that would translate to legal realities in the states is another matter but it’s certainly not as safe as people would have others believe.

It sounds like he just grabbed a cheap VPN and didn’t check to make sure that VPN was “torrent friendly” there is a difference as I used to torrent A LOT . But I have RD and had some very nice people explain it to me without being Dicks that a VPN isn’t needed with RD so I haven’t used it I a few months without any issues. (I only had it because I buy the year and was actively torrenting daily)

It’s not illegal to stream…

Is it safe to use kodi without vpn? Kodi usually has this reminder to use a vpn for security.

First thing i would chk is to be sure he is not dnlding, as opposed to streaming. I can’t imagine anyone using kodi more than me thru out the day and i have never been flagged by my isp. On occasion a torrent link may not work for me and a messge box appears and asks if i want to continue dnlding in the bkgrnd, i always click no, also a setting in the addon for dnlding to keep disabled. Just a couple thoughts and ps, never do i use a vpn.

I have both IPVanish and Real Debrid. My IPVanish yearly subscription expires in a few weeks. Im going to have to check into using Real Debrid without a VPN to see how it works

Ensure to configure dns over tls

Maybe just my ignorance, but didn’t think there was much infringement analysis done in the US. Curious who the ISP is.

“Kodi” doesn’t download or stream anything - specific add-ons like the ones discussed in this forum do.

Some add-ons have the built-in ability to act as a torrent client and download torrents directly. These are dangerous to use without a good VPN. User beware - understand what your particular add-on is doing. There is no difference between streaming and downloading other than intent.

Debrid services will download torrents and cache them on your behalf, so that you are not involved in torrenting directly from your home IP address. A VPN is not necessary with debrid services unless you want an additional redundant layer of security.

Over The Menu no less. Been awhile since I was so excited to see a movie I couldn’t bother finishing.

At a guess, either your VPN dropped and failed to kill the connection, or your DNS leaked through IPv6

Even tho this is specifically a question regarding Kodi add-ons for streaming and a VPN- many are saying it’s not needed w/real-debird ie: other premium service like it. A VPN for some is very much needed/helpful/used for a multitude of other things and debrid services don’t help in that regard. Sorry to be slightly off-topic, but… VPNs do have great benefit(s) compared to NOT having them, just as debrid services greatly do.

Is that right? I use a VPN with Real Debrid but is that unnecessary? I’d love to not use the VPN as I think I get slower speeds :man_shrugging:

he wasnt streaming, he was torrenting

It is now. They changed the law a year or so ago: https://www.cnn.com/2020/12/22/tech/illegal-streaming-felony-covid-relief-bill/index.html
